These Terms & Conditions (“Terms”) govern your access to and use of the Brainripe mobile application, the brainripe website, and any related services (together, the “Service”). The Service is provided by Alma Tech, LLC (“Alma Tech,” “we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf.
2. What Brainripe Is (and Isn't)
Brainripe is a digital wellbeing tool designed to help you understand and reduce your screen time and build healthier habits. The Service is provided for general informational and motivational purposes only. It is not a medical device and does not provide medical, psychological, or professional advice, diagnosis, or treatment. If you are concerned about your health or wellbeing, please consult a qualified professional.
3. Your Account and Device Permissions
Some features require you to grant permissions on your device, such as access to Apple's Screen Time and Family Controls frameworks or notifications. You can revoke these permissions at any time in your device settings, but some features may stop working. You are responsible for maintaining the security of your device and any account associated with the Service, and for all activity that occurs under it.
4. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the app on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions, solely for your personal, non-commercial use.
5. Purchases and Subscriptions
The Service may offer optional paid features, including auto-renewing subscriptions. All purchases are processed by Apple through the App Store, and are subject to Apple's terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your Apple ID account settings. Refunds are handled by Apple in accordance with its policies; we do not have the ability to issue refunds directly. Prices and features may change, and we will give notice of price changes where required by law.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Copy, modify, distribute, sell, or lease any part of the Service;
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
- Interfere with or disrupt the Service, its servers, or networks, or attempt to gain unauthorized access;
- Use bots, scrapers, or automated means to access the Service or the website contact form.
7. Intellectual Property
The Service, including the Brainripe name, logo, pistachio character, artwork, software, and content, is owned by Alma Tech, LLC or its licensors and is protected by copyright, trademark, and other laws. Except for the limited license above, no rights are granted to you. If you send us feedback or ideas, you grant us the right to use them without restriction or compensation to you.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains what information we collect and how we use it.
9. Third-Party Services
The Service relies on third-party platforms such as Apple's App Store and operating system features. We are not responsible for third-party services, and your use of them is subject to their own terms and policies.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will achieve any particular screen time or wellbeing result.
11. Limitation of Liability
To the fullest extent permitted by law, Alma Tech, LLC and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve (12) months before the claim or fifty U.S. dollars (US$50).
12. Indemnification
You agree to indemnify and hold harmless Alma Tech, LLC from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service or violation of these Terms.
13. Termination
You may stop using the Service at any time by deleting the app. We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.
14. Apple-Specific Terms
These Terms are between you and Alma Tech, LLC, not Apple Inc. (“Apple”). Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, or consumer protection claims. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for investigating, defending, or settling any third-party claim that the app infringes intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
15. Governing Law and Disputes
These Terms are governed by the laws of the United States and the state in which Alma Tech, LLC is organized, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in that state, and you consent to their jurisdiction, unless applicable law requires otherwise.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
